SECTION IV. PRIVATE DETECTIVES
19th article.
- Private detectives at the request of natural or legal persons, will:
- Obtain and provide information and evidence of conduct or private events.
- Investigation of crimes subject to prosecution only upon request, on behalf of the legitimate parties in criminal proceedings.
- Surveillance at fairs, hotels, exhibitions and similar areas.
- Except as provided in part c) of the preceding paragraph, detectives shall not be employed or own businesses or engage in security functions of the staff referred to earlier sections of this Chapter.
- They can not carry out investigations on crimes prosecution, and must report immediately to the competent authority any act of this nature that come to their attention by providing all the information and tools which may be obtained.
- In no case may be used for research material or technical means that violate the right to honor, personal or family privacy or image or confidentiality of communications.
PRIVATE SECURITY REGULATION OF ROYAL DECREE 2364/1994
Art.101 functions:
Those established in article 19.1 of the Law of Private Security:
- To obtain and provide information and evidence of conduct or private events.
- Investigation of crimes subject to prosecution only upon request, on behalf of the legitimate parties in criminal proceedings.
- Surveillance at fairs, hotels, exhibitions and similar areas.
Will be considered conduct or private facts which affect the economic, labor, commercial, financial and, more generally, to the personal, family or social origin, excluding the one developed in the homes or places reserved.
In the scope of paragraph c) shall be considered including large commercial and public buildings.

Likewise, Article 265.1.5 states "In any claim or defense must be accompanied ... .." "The reports produced by private research professionals legally entitled on those facts relevant to support their claims. On these facts, if they are not recognized as true, oral evidence will be done. "
1. REQUIREMENTS FOR OBTAINING THE PRIVATE DETECTIVE LICENSE
a) Be an adult.
b) Have the nationality of a European Union country or a State party to the Agreement establishing the European Economic Area.
c) Have the physical and mental attributes necessary to exercise their respective functions without suffering from illness that prevents the exercise of them.
d) Lacking a criminal record.
e) Not have been convicted of trespass in the field of protection of the right to honor, personal and family privacy and image, secret communications and other rights in the five years preceding the application.
f) Not have been convicted on two or four years, respectively, for serious or very serious breach in security.
g) Not have been separated from service in the Armed Forces or the Security Forces.
h) Having not exercised control functions of the institutions, services or actions of security, surveillance and private investigation, or its staff or facilities, as a member of the Security Forces in the two years preceding the application.
i) To overcome the evidence of the knowledge and skills necessary for the performance of the respective functions.
j) Hold a secondary school, or equivalent or higher certificate.
k) Hold private detective diploma awarded by the Institute of Criminology or other appropriate official centers and authorized by the Ministry of Education and Culture and obtained after beating the established programs, which comprise 180 credits each for ten hours of teaching, developed at least three courses of teaching.
l) Not to be active official of any government at the time of the application, and during the two years prior to it.
2. ENABLE
To obtain the authorization as a private detective following documentation must be provided:
- Photocopy of DNI or, where appropriate, residence card or identity into force, stating the holder's nationality and expression of Foreigner's Identity Number (NIE).
- Medical certificate of fitness and possess psychic ability required for appointment to the post (Accreditation in the manner provided in the second transitory provision of the Order of July 7, 1995).
- Criminal record certificate issued by the Central Register of Convicted Persons and Rebels for Spanish and foreign residents in Spain and equivalent to the original document and having the same effect for non-resident foreign applicants.
- Declaration referred to in Article 20 of Law 23/1992 and paragraphs e) and f) of Article 53 of Royal Decree 2364/1994.
- If it had been a member of the Security Forces or military career, a document stating that the administrative status is and meet the requirements of Article 53 g) and h).
- Certified photocopy of bachelor's degree or equivalent.
- Photocopy of diploma from a private detective recognized for this purpose by the Institute of Criminology.
- In the case of personnel working for the government, stating the provisions of the Fourth additional provision of Royal Decree 2364/1994.
- Document proving to be registered in the IAE, to open office detectives, or possibly higher in Social Security, associated or dependent detectives.
- 2 passport-sized photographs that meet the requirements set out in Annex 5 of the Order of July 7, 1995.
- Receipt proving to have made the entry fee for enabling the private detective and their respective specialties, according to the model 750, in favor of the Treasury, in banking or collaborating savings banks (restricted account of the State Agency Tax Administration) The above model 750 will be provided in the Police Station and must be completed with the data, noting the eighth as applicable fare and the ticket will be delivered with copy to the Administration.
- Sequence number of commissioned research and its date
- Name or business name and address of the client and the person or persons investigated
- Display Case
- End date of research assignment
- Known officially punishable offenses
- Body to which reported
- If it is computerized, it must adhere to the provisions of the legislation on personal data protection.
- Private detectives civilly liable for the acts or omissions that, during the execution of their services, incurred by detectives dependent or associated with them are linked.
- The leaves of the Book-Registration detectives or, where appropriate, the leaves or media used for the later formation of one, must be numbered and sealed prior to the start of the endorsements.
- In its first leaf, Police Headquarters, Provincial or Local Police Station or the Police for Autonomous territorial demarcation of the firm or its delegations, settle the measure of empowerment of the Book. In the proper record shall contain the following:
- Intended use to which the Book
- Name of the holder of the office detective
- Order Number Registration Detective
- Number of pages that comprise the Book
- Precept completing due diligence
- Place and date thereof, shall be signed by the respective offices responsible for police or his delegate.
3. PROHIBITIONS
Private detectives will not conduct research on crimes prosecution, and must report immediately to the competent authority any act of this nature that come to their attention by providing all the information and tools which may be obtained related to these crimes.
In no case may use for your personal research or technical means that violate the right to honor, personal or family privacy, to self-image or the secrecy of communications.
4. DETECTIVES COMPANIES
Commercial companies, labor unions detectives or should be formed only by persons authorized by regulation as such, must submit to the Directorate General of Police, for entry in the registry, a certified copy of the deed of constitution society and the registration certificate or notice thereof in the register.
Also communicate any changes that occur in the composition of the management bodies of the company, ownership of shares representing the capital and in the increases or decrease it. The communication must be sent to the Directorate General of Police within fifteen days from the date of the grant deed or the occurrence of the change in question, corresponding to the said management center to issue the notification to the competent Autonomous Community.
The members of these companies may only engage in the conduct of the activities of the detectives, unable to develop any of the assigned exclusively to security companies.
5. ESTABLISHMENT OF BRANCHES
The private detective firms may establish offices or branches in different localities in any case must be addressed each enabled by a detective in accordance with the provisions of the Private Security Regulation.
To do so must first inform the General Police Directorate, which will transfer to the competent Autonomous Community, the opening of the office or branch, to determine their location and accompanying documents relating to the detectives who will work in the same.
